By accessing or using SmartMedReport ("the Service", "we", "us", or "our") at app.smartmedreport.com or smartmedreport.com, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and anyone who accesses the Service.

By creating an account or using any feature of the Service, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.

SmartMedReport is an AI-powered web application that allows users to upload images of medical reports and receive plain-language explanations of their contents in up to 20 languages.

The Service includes:

• AI-powered analysis of uploaded medical report images
• Plain-language explanations in your chosen language
• Support for 20 languages including English, Hindi, Bengali, Arabic, Spanish, French, and more
• Downloadable PDF reports of the AI analysis
• A personal dashboard to view your report history
• A credit-based system for purchasing analyses

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

You acknowledge and agree that:

• The AI analysis is generated automatically and may contain errors or inaccuracies
• You will always consult a qualified, licensed healthcare professional before making any medical decisions
• SmartMedReport is a tool to help you understand your reports — not to replace professional medical evaluation
• We are not responsible for any health decisions made based on the analysis provided
• In a medical emergency, you should contact emergency services immediately

To use SmartMedReport, you must create an account by providing a valid email address and password. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access to your account at support@smartmedreport.com
• Accept responsibility for all activity that occurs under your account
• Not share your account credentials with any other person
• Not create multiple accounts to circumvent any restrictions or to obtain additional credits

We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion, particularly in cases of suspected fraud or misuse.

SmartMedReport operates on a credit-based system. Each report analysis consumes one credit from your account balance.

By purchasing credits, you agree to the following:

• Credits never expire. Once purchased, credits remain in your account indefinitely until used.
• All payments are processed securely. We do not store your payment card details.
• All prices are listed in US dollars (USD) and are subject to change with notice.
• Credits are non-transferable and may only be used by the account holder.
• Credits used to generate a report are consumed regardless of whether you are satisfied with the result, as the AI processing is completed upon submission.

Billing Disputes: If you believe you have been charged incorrectly, please contact us within 30 days of the charge at support@smartmedreport.com. We will investigate and respond promptly.

You agree to use SmartMedReport only for lawful purposes and in a manner consistent with these Terms. You must not:

• Upload images that are not medical reports or that are intended to mislead or test the system maliciously
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or source code of the Service
• Use automated tools, bots, or scripts to access or scrape the Service
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Upload content that contains malware, viruses, or other harmful code
• Use the Service to harass, defame, or harm any individual or group
• Resell, sublicense, or commercially exploit the Service without our written permission
• Create multiple accounts to obtain additional free credits
• Use the Service in any way that could damage, overload, or impair our infrastructure

Violation of these rules may result in immediate suspension or termination of your account without refund.

All content, features, functionality, design, branding, and technology of SmartMedReport — including but not limited to the website, application, AI models, logos, and written content — are the exclusive property of SmartMedReport and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purposes.

You retain ownership of any medical report images you upload. By uploading content, you grant us a temporary, limited license to process that content solely for the purpose of generating your analysis. We do not claim ownership of your uploaded content.

You may not copy, reproduce, distribute, or create derivative works based on our Service or its content without our express written consent.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, SmartMedReport disclaims all warranties including:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, completeness, or reliability of any AI-generated analysis
• Warranties that results from using the Service will meet your expectations

We do not warrant that errors in the Service will be corrected, or that our servers are free of viruses or other harmful components. We are not responsible for any damage to your device arising from use of the Service.

To the fullest extent permitted by applicable law, SmartMedReport and its operators, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, goodwill, or other intangible losses
• Any health outcomes or medical decisions made based on AI-generated analysis
• Any unauthorized access to or alteration of your transmissions or data
• Any interruption or cessation of the Service
• Any errors or inaccuracies in the content or analysis provided

In no event shall our total liability to you for all claims exceed the amount you paid to us in the 12 months preceding the claim, or $50 USD, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not fully apply to you.

Either party may terminate this agreement at any time:

• You may delete your account at any time by contacting us at support@smartmedreport.com. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
• We may suspend or terminate your account immediately if we believe you have violated these Terms, engaged in fraud, or posed a risk to the Service or other users.

Upon termination:

• Your access to the Service will be revoked immediately
• Any unused credits in your account will be forfeited unless we determine otherwise at our sole discretion
• Provisions of these Terms that by their nature should survive termination will remain in effect, including Sections 7, 9, 10, and 12

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with applicable rules.

You agree that any legal action or proceeding related to the Service shall be brought exclusively in the courts of competent jurisdiction, and you consent to personal jurisdiction in such courts.

We reserve the right to update or modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Send a notification email to all registered users
• Display a prominent notice within the application

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and may request account deletion.
